Together with the Account, a Member will be provided with a user identification ("User ID") and password ("Password") specific to the Member’s Account which the Member may use to navigate and participate in the activities on the Site.

 

SIMTech shall be entitled to disclose the User ID, Password or Account particulars to any third party if required to do so by any law, regulation or court order.

 

Members shall :-

 

SIMTech reserves the right at its sole discretion to remove or edit Your Material or any content from any forum on the Site at any time without providing any reason and without notice.

 

SIMTech values the privacy of the Member. It is SIMTech’s policy that any personal information collected will not be sold to any third parties. However, SIMTech retains the right to release Member’s personal information and contents posted by the Member to proper authorities when required by law or when, in good faith, SIMTech believes that SIMTech must release the information to:

(a)     satisfy a legal order or comply with legal process;

(b)     defend the rights of SIMTech or its affiliates or business partners;

(c)     protect the personal safety of SIMTech’s employees, agents, affiliates, business partners, customers, or Site users.

 

The Member acknowledges that:-

(a)   there may be inadvertent disclosure of information by SIMTech and/or any of SIMTech’s employees in the course of providing information, whether to other Members or third parties in Singapore or elsewhere, relevant to activities or transactions made or purported to be made by the Member and the Member consents to such inadvertent disclosure; and

(b)               equipment and software providers, service providers, content providers, network providers (including but not limited to telecommunications providers, Internet browser providers or Internet access providers) and other Members may have or be able to gain access to any information transmitted over the Site or other systems, and the Member agrees not to hold SIMTech responsible or liable in any way in this respect.

 

All facilities, software, information, contents and features Members use or receive through the Membership or by the use of the Account or Site (“Facilities”) and all contents included by the Members or otherwise to the Site, including text, graphics, logos, button icons, images, audio clips, digital downloads, data, data compilations and software shall solely vest in and belong to SIMTech or its suppliers.

 

Information available on the Site is for use and circulation only by and between the Members.

 

SIMTech has no control over any websites of third parties which Members may access through the Site and makes no warranty as to the accuracy, reliability, timeliness, legality or decency of the contents, or the security or privacy of such websites.

 

SIMTech disclaims all responsibility and liability for the use of such third party websites, which are accessed and used at Member’s own risk. Any third party that wishes to establish links to the Site must notify SIMTech of their intention prior to doing so.

SIMTech shall not be held liable for and the Member agrees to indemnify, defend and hold harmless SIMTech and its affiliates against all proceedings, costs, expenses, liabilities, injury, death, loss or damage arising out of the breach or negligent performance or failure in performance by the Member of these Terms and Conditions or from the use of the Account, User ID, Password, Facilities or Site howsoever caused.

 

All Facilities are provided "as is" and "as available" and is used by the Member at the Member’s sole risk. SIMTech makes no express or implied warranties, conditions or representations whatsoever, and specifically disclaims the same including without limitation, any warranties, reliability, title, non-infringement of the Facilities, merchantability and fitness for a particular purpose. SIMTech does not warrant that the Facilities, Account, Site, server or other facilities used will be free from viruses or harmful components or that the Facilities will operate in an uninterrupted or error-free manner.

 

In no circumstances shall SIMTech be liable to any Member in any way whatsoever for any direct, indirect, special, incidental or consequential damages, including but not limited to lost profits and savings, whether based in contract, tort, strict liability or otherwise arising out of or in connection with the use of any Account, User ID or Password or the use or reliance on the Site or any of the Facilities, even if SIMTech has been advised of the possibility of such damages. The above limitation of liability shall apply to the extent permitted under the applicable law.

 

The Membership shall automatically renew upon each anniversary unless terminated in accordance with the provisions below. Notice of payment of annual dues shall be sent to the Member sixty days before the end of the Membership Term. Should the Member choose not to renew the Membership, the notice of payment should be returned to SIMTech with the appropriate check-box selected within 14 days of the date of the notice of payment.

 

The Membership may be terminated by either party giving to the other sixty (60) days notice in writing. Cancellations become effective during the month of cancellation.

 

SIMTech reserves the right to terminate or modify or change these terms and conditions at any time which the Members shall be deemed to have notice of.

 

Should the Membership be terminated at any time by SIMTech or Member for any reason, there will be no refund of fees paid. 

 

The use of the Site and these Terms and Conditions shall be governed and interpreted according to the laws of Singapore.
